History of prosecution and repressions of Krasnoyarsk authorities against Non-Government Organization "Citizens` Center on Nuclear Non-Proliferation"
In September 2006 Krasnoyarsk environmentalists Vladimir Mikheev, Vitaly Khizhnyak (both - members of Krasnoyarsk Governor`s Coordination Council for Radiation Safety) and Yury Pirogov - Deputy to Sukhobuzimo District Council decided to walk with dosimeters around the Yenissei banks in the vicinity of Bolshoi Balchug township, to see how the radiation situation had changed after the spring flood. On the off chance they took with them a lead container - what if a "hot" would turn out. In advance, in August 2006 they agreed with an employee of "Quant" Ltd. - Dementiev A.S. - Head of Department): "If we find anything - will you take it for burial?" "No problem! This is our duty. But you`ll have to pay 4700 rubles for the package with soil".
An they did find it. Actually- one "hot" particle only! In the beginning it was believed that there were five particles, even the instrument readings were photographed (later the instrument had been found to fail, it had to be taken to the MCC to be fixed). Then, with all proper precautions brought into two in the lead container. That`s when everything began...
Detective Story. Or a Provocation?
Early November 2006. A call from local TV company "TVK" (Maria Bukhtueva): someone found almost thirty "hot particles" in one area, almost close to each other. Even photographs of dosimeter with its readings are available. At the same time the Rospotrebnadzor (Federal Agency on Surveillance for Consumer Rights Protection and Human Well-Being) assures that everything is clear there. A lie? Hiding? Please, come and give your comments. Vitaly Khizhnyak came and gave his comments. In brief: to find even five particles in one place... - something fantastic. MCC representatives write about 50 found "hot" particles only. After a while another call: we were mistaken, not 20-30 particles but 12 (or something about). The source of information is not disclosed. The particles are very close - several centimeters, one meter from each other. Even the spot was marked. But the person who found it is not named. Khizhnyak offers the TV people his services and even at his own expense...
November 14, 2006. Again a call from "TVK": one particle was brought. They suggest to take it, put into our container and submit to "Quant" together with our particles. Under grat secrecy Khizhnyak and Mikheev were brought almost to the outskirts of the city, then after some time (detective story!) this particle was brought in a tin can. Spare soil was removed, its remaining part (with the particle) was poured into a polyethylene package and placed into our container.
November 22, 2006. After this the environmentalists took their lead container to "Quant" Ltd. (in an armored carrier accompanied by SWAT - this is a joke). Dementiev A.S. made measurements of the dose at the distances of 10 cm and 1 m (to tell straight off the measurement results were not impressive: at the distance of 10 cm one could stay as long as one month without any consequences, at the distance of 1 meter - normal background). He accepted the packages with soil, wrote Protocol № 21 of dosimetric measurements in acceptance of radionuclide sources and Transfer-Acceptance Act # 191 on which the green put their signatures and assured the environmentalists that the next day Director Bekhtev S.I. would sign the documents and we would be able to take them.
Unfortunately Bekhtev got afraid of something - what if something happens (a coward, the green have long doubted his professionalism). Dementiev A.S. is another pair of shoes - he is a professional and he was aware what he was doing. To tell the truth, "I`m boss - you are not; you are boss - I`m not". Repeated attempts to reach Dementiev and Bekhtev for the next several days failed... It was December 1, 2006 only when Dementiev told us by phone that we should wait, because "Quant" appealed to Rospotrebnadzor Directorate to have some consultations. After that one month passed but environmentalists received neither the Transfer-Acceptance Act, nor the Protocol of dosimetric measurements... Later it turned out that on demand of Krasnoyarsk Krai Prosecutor`s Office Bekhtev sent the "hot" particles to MCC for analysis.
December 7, 2006 - a session of the Krasnoyarsk Governor`s Coordination Council for Radiation Safety. Vladimir Mikheev tells the attendees and vice-governor Gnezdilov about the red tape with documents at "Quant" Ltd. with respect to the "hot" particles found by a public organization. Romashov A.A., member of the Coordination Council, vice-speaker of the Krai Legislative Assembly (by the way, former high-ranking official of MCC) suggested to involve the Prosecutor`s Office to find out who in Krasnoyarsk transports radioactive substances without license. The chairman of the coordination Council liked the idea and gave the order.
December 20, 2006. Representatives of the Citizens` Center on Nuclear Non-Proliferation thought that the government authority represented by "Quant" Ltd. stonewalls the facts of radiation contamination of Krasnoyarsk krai contamination. Therefore, the environmentalists had to appeal for support to Russian mass media and Krasnoyarsk krai Prosecutor Feoktistov S.V.
December 22-26, 2006. Before the New Year Russian Information Agency "Novy Region" (New Region) publishes two articles:
January 17, 2007, Vladimir Mikheev received a request of from Nesterov A.S., Head of Krasnoyarsk Department of Gosatomnadzor with a reference to the demand from the Krai Administration Security Council (now we understood where everything comes from, i.e. the order with a oodles of questions as many as 15). However, since the questions were beyond (below) environmentalists` understanding the answers were in the same vein. As the question so is the answer ""Apples and Oranges" or How Vladimir MIkheev and Vitaly Khizhnyak "contaminated" Krasnoyarsk with "Hot Particles"... almost a feuilleton").

Summons to the Prosecutor`s Office of Zheleznodorozhny District and Krasnoyarsk Environment Protection Prosecutor`s Office
January 26, 2007. Friday evening a messenger from the Prosecutor`s Office of Krasnoyarsk Zheleznodorozhny District brought a curious document. The Prosecutor`s Office of Zheleznodorozhny District "in connection with the order of Krasnoyarsk Krai Prosecutor`s Office", (demanded in very short time (before Monday (!) January 29, 2007) to present certified copies of the Charter of Organization (as amended), State Registration Certificates, Minutes of Meetings (Resolutions) of the general meeting of members and the Board of Directors of the Citizens` Center on Nuclear Non-Proliferation for the period of 2005-2006, a copy of bookkeeping balance sheet, statement of profit and loss, report on proper use of allotted funds for 2005 2006 and so on (total list of 28 names (!) of documents).
At the same time arrived a summons from Krasnoyarsk Krai Environment protection Prosecutor`s Office. Vladimir Mikheev was invited there for January 29 (!) 2007 having constitutive documents of the Organization (Charter, State Registration Certificate, Tax Registration Certificate), Chairman Assignment Order (Resolution passed by voting of the members of the public organization, employment position instructions and a license for activities to handle radioactive substances.
All documents required for two Prosecutor`s Offices were presented and all clarifications and explanations were made... After this Prosecutor Assistant of Krasnoyarsk Zheleznodorozhny District said, that now the environmentalists are to solve all questions with Krasnoyarsk krai Directorate of the Federal Registration Service (Rosregistratsiya) only... Krasnoyarsk krai Directorate of the Federal Registration Service: "velvet paws hide sharp claws"
Activities of the Citizens` Center on Nuclear Non-Proliferation over 2005-2006 have undergone integrated financial checkout by Krasnoyarsk krai Directorate of Rosregistratsiya. We had to answer numerous questions of two Prosecutor`s Offices and Rosregistratsiya Directorate. Oodles of papers were written, officials of all levels faithfully filed them in dossiers against environmentalists.
Prosecutor`s Office of Zheleznodorozhny District and Rosregistratsiya Directorate initiate administrative cases against the Citizens` Center on Nuclear Non-Proliferation and head of this organization- Vladimir Mikheev.
March 9, 2007. Prosecutor of Zheleznodorozhny District decrees to instigate administrative under Article 19.7 of the Code of the Russian Federation on Administrative violations against Krasnoyarsk Regional Public Charity Organization "Citizens` Center on Nuclear Non-Proliferation" and head of the Organization Vladimir Mikheev for failure to present reports to the Directorate of Rosregistratsyia.
March 27, 2007. Justice of the peace Belova S.N. issues two decrees on the fact of committing an administrative violation:
In the course of two months` checkout of the Citizens` Center on Nuclear Non-Proliferation the Krasnoyarsk Krai Directorate of the Federal Registration Service found so-called "law violations" and made the environmentalists amend the charter of the Organization, concerning, in particular branches of the Center. May 21, 2007 an official message was presented to the Rosregistratsiya Directorate, head of Non-Commercial Organization Control Department abount amendments made in the Charter of Organization and the Directorate had no objections. On May 28, 2007 we submitted the package of required documents having paid the state duty - 400 rubles and the notary officer - 300 rubles.
June 18, 2007. After this the environmentalists received official rejection... Officials of Rosregistratsiya again order the environmentalists to repeat the procedure... and pay again.
Few and only benefits
February 12, 2007. representatives of public environmental organizations of Krasnoyarsk met again with Gavrilov P.M. - MCC Director-General. The subject of the meeting were the problem of "hot" particles. MCC Director said that to take the "inventory" - pedestrial gamma-survey of placed with increased gamma background in the summer of 2007 it is possible to invite representatives of public environmental organizations as participants or observers; the environmentalists response to the suggestion was positive. In the process of communication, exchange of opinions, discussion the combine workers and environmentalists came to the conclusion that it was time to raise the level of interaction and to interact on a more regular basis. For this plans of further collaboration between the Combine and Krasnoyarsk environmentalists has been outlined and Protocol of Intentions has been signed.
Environmentalists are Framed Up a Bit Too Thin
This seemed to be the time to close the chapter. The city is saved from radiation damage by one "hot" particles packed in a lead container! Vladimir Mikheev and the public organization are checked by numerous inspections... The NGO is under mighty pressure from all sides to paralyze the activities of environmentalists :
But! Someone is very eager to institute criminal proceedings against the green... Krasnoyarsk krai authorities needed to create a precedent and put in the dock two environmentalists. It should be noted that at that period not a single person in Russia was convicted under part 1 Article 220 of the Criminal Code of the Russian Federation "Illegal Handling of Radioactive Materials or Radioactive Substances". "Illegal acquisition, storage, transfer or damage of nuclear materials or radioactive substances - is punished by custodial restraint for the term up to two years or apprehension for the term up to four months or deprivation of freedom for the term up to two years". Unprecedented wish of the authorities!
However, to date there are already three (!) Orders to dismiss criminal complaint against Mikheev V.I. and Khizhnyak V.G. by constituent elements of offence created by part 1 Article 220 of the Criminal Code of the Russian Federation - because of absence of crime in the act.
March 12, 2007 Krasnoyarsk Directorate of Internal Affairs received from Krasnoyarsk krai Prosecutor`s Office by the report of Vigel A.N., Krasnoyarsk Environment Protection Prosecutor, Councillor in Justice materials stating facts of allegedly illegal acquisition and transfer of radioactive materials by Mikheev V.I. and Khizhnyak V.G. the documents were related to the very independent survey of coastal strip near Boloshoi Balchug township in the process of which the environmentalists found the "hot" particle brought and handed over together with an other "hot" particle received from TVK to specialized organization "Quant" Ltd. for burial. When March 22, 2007 the material was checked at Krasnoyarsk Directorate of Internal Affairs order was issued to dismiss criminal complaint against Mikheev V.I. and Khizhnyak V.G. under Part 1 Article 220 of the Criminal Code of the Russian Federation.
However, on March 26, 2007 the order to dismiss the criminal complaint made on March 22 2007 is cancelled by Krasnoyarsk Prosecutor`s Office and material is sent for additional inspection. On April 3, 2007 Krasnoyarsk Directorate of Internal Affairs on the basis of additional inspection the second order was made which again dismissed criminal complaint the second order was made which again dismissed criminal complaint on the crime created by P. 1 Article 220 of the Criminal Code of the Russian Federation against Mikheev V.I. and Khizhnyak V.G.
However, on May 4, 2007 Vice Prosecutor of Krasnoyarsk krai again cancels the said order to dismiss criminal complaint and materials (for the third time!) is sent to Krasnoyarsk Directorate of Internal Affairs for inspection. On the basis of the next additional checkout held on May 18, 2007 Krasnoyarsk Directorate of Internal Affairs makes the third (!) order, concerning the information about the crime of illegal acquisition, storage, transfer of radioactive materials which again dismisses the criminal complaint and, expectedly because of absence of crime in the act.

Another round in the so-called case of "hot" particles or administrative prosecution
June 7, 2007. When workers of three (!) Prosecutor`s Offices failed to institute criminal proceedings against Vladimir Mikheev and Vitaly Khizhnyak Krasnoyarsk Environment Protection Prosecutor`s Office decreed to institute administrative proceedings against legal entity - Krasnoyarsk Regional Public Charity Organization "Citizens` Center on Nuclear Non-Proliferation" and office holder - Director of CCNN Mikheev V.I. under Article 8.2 of the Code of the Russian Federation on Administrative Violations "Failure to comply with ecological and sanitary-epidemiological requirements in handling production and consumption wastes or other hazardous substances ".

June 13, 2007. Now the Prosecutor`s Office accuses the public organization to have allegedly violated the requirements of waste handling, because the soil with the "hot" particles in one of the packaged delivered for burial to "Quant" Ltd., should be considered low active radioactive wastes. Formally this means that the soil in the form of radioactive wastes can be transported only if a special permission (license) is available. Of course, the environmentalists disagreed with the accusations of the Prosecutor. In more detail the arguments of the green are stated in the explanation by Vladimir Mikheev to Krasnoyarsk Environment Protection Prosecutor in connection with institution of the administrative proceedings against the environmentalists under Article 8.2 of the Code of the Russian Federation on Administrative Violations".
For the thousand`s time Krasnoyarsk Environment Protection Prosecutor`s Office demonstrated its prepossession towards Krasnoyarsk environmentalists... and, we think, slavishly abide by next political demands of krai authorities.
June 18, 2007. Krasnoyarsk krai Directorate of Rospotrebnadzor sent Decision "On appointing the time and venue for proceedings of the case of administrative violation - for June 28 2007."
June 28, 2007 summoned is the second Decision "On postponing proceedings of the case of administrative violation because of production necessity for - July 10, 2007.
July 10, 2007. Krasnoyarsk krai Directorate of Rospotrebnadzor made two decrees on the so-called case of "hot" particles.
Court proceedings took 15 minutes only, environmentalists were even not allowed to investigate the files of the case. It was only here that they saw the Transfer-Acceptance Act and the Protocol of Dosimetric Measurements in Transfer of Radionuclide Sources from Krasnoyarsk Regional Public Charity Organization "Citizens` Center on Nuclear Non-Proliferation" to "Quant" Ltd., and the Protocol of Measurements of "Hot" Particles by the MCC Radioecological Monitoring Laboratory handed over by the Citizens` Center on Nuclear Non-Proliferation" to "Quant" Ltd. Request of Vladimir Mikheev, Director of the Center to hand the Resolution over "by hand" received positive response. In 4 minutes Mikheev was handed over the Resolutions where the amounts of penalties were written in handwriting, while the resolutions were prepared beforehand :

June 18, 2007. A short respite after official rejection from Rosregistratsiya Directorate the environmentalists decided not hasten to repeat the proceedings... and pay the state duty and the notary officer :
October 15, 2007. Vladimir Mikheev was again summoned to the Non-Commercial Organization Control Department of Krasnoyarsk krai Rosregistratsiya Directorate. Head of the Department Vagina T.V. presented Mikheev Warning № 53-06/21460 of August 16, 2007, which he learnt for the first time in her presence on October 15, 2007, attested by inscription on the Warning "Learnt on October 15, 2000. I`ll submit the document October 26-29, 2007 (signature) Vladimir Mikheev".

Battles with the tax inspection
March 13, 2007. Krasnoyarsk Zheleznodorozhny District Federal Tax Service Inspection sends the environmentalists the first Demand to present documents for three-year period (2004-2006). Among other things the tax inspectors are interested in all documents confirming award of two grants by the Democracy Commission of US Embassy in Moscow and from the Blacksmith Institute (USA). The Inspection also demands to present the Ledger, ledgers for account 50 and 51, documents to the документы ledgers for account 50 and 51.
April 6, 2007. Krasnoyarsk Zheleznodorozhny District Federal Tax Service Inspection sends the environmentalists the second Demand to present documents for three-year period (2004-2006). Now the tax inspectors are interested in 51 (!) financial statement. At the same time the environmentalists receive Resolution № 39 to appoint an on site tax inquiry of Krasnoyarsk Regional Public Charity Organization "Citizens` Center on Nuclear Non-Proliferation" on correct computation of taxes and timely payment of 13 taxes and duties, reliability of report data in the bookkeeping balance sheet for the three-year period. Subject to verification are five more items: correct tax assessment of hard currency receipts, compliance with hard currency laws, etc.
May 16, 2007. Krasnoyarsk Zheleznodorozhny District Federal Tax Service Inspection sends the third Demand to present the following documents:
All documents were presented accurately and in time. What`s more, at the suit of Zheleznodorozhny District Inspection the document from the US Embassy in Moscow was made on stamped watermarked paper with coat-of-arms seal under the text in the Russian language, but James Kenny, Head of the Press and Culture Department of the US Embassy did not sign this document. The thing is that by the American law Embassy employees can sign the document in their native English language only...
June 5, 2007. Krasnoyarsk Zheleznodorozhny District Federal Tax Service Inspection issued the environmentalists Resolution № 39/1 to suspend from June 4, 2007 the on site tax inspection because of necessity to call for documents from other organizations. I.e. the inspection started a two-months cross-audit of all organizations which have been paid from the funds of the "Citizens` Center on Nuclear Non-Proliferation" for three years.
August 29, 2007. Krasnoyarsk Zheleznodorozhny District Federal Tax Service Inspection issues Resolution № 39/2 to resume since August 29, 2007 the on site tax inspection. The same day V. Mikheev receives from the tax inspectors Certificate on the on site tax inspection performed which had actually no significance. The main documents is the Act, which as he was told would be ready in two (!) months.
October 26, 2007. Seven (!) and a half months after the first Demand of March 13, 2007 to present the documents for the three-year period or six (!) and a half months after Resolution № 39 of April 6, 2007 to appoint on site tax inspection of the "Citizens` Center on Nuclear Non-Proliferation" the tax battle was over. This gala day the environmentalists received the long-awaited document - Act № 82 of the on site tax inspection on 11 pages, Supplements to the Act on 4 pages and Protocol № 130 on 4 pages on administrative violation (!?). As the phrase goes, we arrived at where we started : Schooled by experience in such woes Vladimir Mikheev writes in the Protocol: "I disagree with № 82 of 26.10.2007. Disagreement on this Act shall be presented within 15 working days (signature) Mikheev V.I. I disagree with the Protocol (signature) Mikheev V.I. ".
Working hard for seven and a half months the tax inspection checked three years of financial activities of the Citizens` Center on Nuclear Non-Proliferation and found non-payment of taxes, penalties and fines amounting to 6 thousand rubles. The environmentalists agreed with some of the remarks, but strongly disagreed with the income tax. Therefore, the green shall present their disagreement in statutory period. From the Protocol it is clear that now Vladimir Mikheev is to be brought to responsibility under Article 15.11 of the Code of the Russian Federation on Administrative Violations "Gross violation of rules of accounting records maintenance and presentation of accounting statements". This article creates administrative penalty on office holders in the amount from two thousand to three thousand rubles.
"Witch hunt" of Information War
September 6, 2007. Because of failure to appear in court of representatives of Krasnoyarsk environment Protection Prosecutor`s Office and Rospotrebnadzor Directorate Krasnoyarsk Central District Court postponed consideration of two appellate appeals of the "Citizens` Center on Nuclear Non-Proliferation" for October 3 and 4, 2007. Later the prosecution did not appear in court intentionally: Read about it below.
September 6, 2007. Krasnoyarsk krai Governor`s Coordination Council for Radiation Safety of Krasnoyarsk krai Population held its session. Secretary of the Council - Khizhnyak V.G. and member of the Council - Mikheev V.I. were not invited (!) to the session. Conclusion suggests itself: the environmentalists are unwanted for the krai authorities and the officials decided henceforth to keep the public organization off. By the information of state TV channel "Yenissei-Region": ": the krai administration are seriously thinking of restraining access of such environmental organizations to radiation background investigation in the krai". After the session of the Coordination Council Anatoly Kovrigin - Secretary of the krai administration Security Council invited local journalists and said the following: "The boom around the allegedly found on the bank of the Yenissei near Bolshoi Balchug township "hot particles" is stirred up by the US-funded public organization". According to the Security Council Secretary the "Citizens` Center on Nuclear Non-Proliferation is an organization funded by the American side and intentionally distorts the situation. Making references to reports received from the Center for Nuclear Nonproliferation the Americans are in a position to state that public organizations in Krasnoyarsk krai are prosecuted, which - I underline this - was not so, and also state that the radiation situation downstream the Yenissei is troublesome", - explained Kovrigin.
September 6- 26, 2007.
September 10, 2007. While government TV channel "Yenissei-Region" almost accused V. Mikheevа of espionage for US, an other government TV channel "Krasnoyarsk GTRK" went even further and issued the following gem of journalism: "It is logical to assume the US project to be aimed to cause mistrust of township residents and of the entire krai to its authorities. Now it is possible to state - Russian specialists are unable to manage the safety of atomic industry facilities.
Maximum goal is, if possible to retard development of the nuclear industry. The results of US special services` interference into the political situation in Ukraine is common knowledge - the country is split. We`d like to prevent such abuses of figures here - when a Russian organization manipulates unreliable information to deceive people and all this is done with the money of western government funds".
I`d rather not comment this information delirium... To the credit of Krasnoyarsk journalists we should note the following: out of six Krasnoyarsk TV channel only two government ones - "Yenissei-Region" and "Krasnoyarsk GTRK" sailed torrents of dirty slander on the Citizens` Center on Nuclear Non-Proliferation. And, of course, the government krai radio. To assess the results of this government smear campaign we`d like to cite only one comment at "News Laboratory" site: "Haw, haw, it is a pity that Geiger counter cannot speak, otherwise they would refuse from their own readings". I`m no judge of the audience of these TV channels, but in the Internet the "Yenissei-Region" and "Krasnoyarsk GTRK" sites have neither visitors` counters, nor users` geography http://top100.rambler.ru/top100/ , nor topical citation index http://yandex.ru/. Therefore, there is nothing to comment...
April 12, 2007. The case of Krasnoyarsk environmentalists evoked wide international response in the context of general situation with Russian non-government organizations (NGO). Heads of 15 local non-government organizations and Colin Cleary - head of US Embassy Political Department. They discussed questions about position of public organizations and civil society in Krasnoyarsk krai; questions the public organizations work on and problems they face in their activities. Under discussion was the political situation in the krai and in Russia on the whole, the situation with human rights and freedoms (among them the freedom of speech, press, etc.). Environmental public organizations of Krasnoyarsk krai were represented only by Vladimir Mikheev - Director of the Citizens` Center on Nuclear Non-Proliferation. During the discussion of these burning issues Olga Likhtina - Director of Krasnoyarsk krai Center for Human Rights directly said, that environmentalists are experiencing actual repressions. Likhtina`s knowledge is first hand, she is a lawyer and represented the interests of the Citizens` Center on Nuclear Non-Proliferation both at the justice of peace and in the investigation section on the sensational case of "hot" particles. Vladimir Mikheev also criticized the krai authorities emphasizing that his organization had never experienced such a pressure. According to him "this is a real offensive against environmentalists". No sooner had the resolution to dismiss criminal complaints under part 1 Article 22 of the Criminal Code of the Russian Federation against citizens Mikheev V.I. and Khizhnyak V.G. been received, than the tax inspection got down to business... Late March Vladimir Mikheev took a bag with requested financial statements for three years. This was not enough - and now the tax inspection calls for more 60 documents more. The question of the Center Director was answered that the checkout is complex and the law allows two months (!) for it. Actually the checkout took as long as seven (!) and a half months.
September 23, 2007. Delegates to the First Kiev International Ecological Forum (International Conference "Europe- Asia: Collaboration for Sustainable Development "), representing 18 countries of the world passed a statement protesting against prosecution of their colleagues - Krasnoyarsk environmentalists of the Citizens` Center on Nuclear Non-Proliferation Vladimir Mikheev and Vitaly Khizhnyak.
In the Statement the delegates to the Forum draw the attention of decision makers and mass media to the situation with the rights of environmentalists and all citizens of Russia. "The legacy of the cold war, consequences of atomic engineering development without account of environment protection requirements, tremendous amounts of radioactive wastes, unprecedented radiation contamination is the severe ecological problem of Russia. To solve this problem requires to consolidate efforts of state authorities and non-governmental organizations. In its stead in Russia the environmentalists disclosing information about radioactive contamination and protecting rights of the population are repressed by the authorities ", - reads the Statement.
The delegates to International Ecological Forum "consider inadmissible prosecution of environmentalists performing important public work ".
"We consider absurd and politically incorrect statements of government mass media (local government TV channels, in particular) accusing environmentalists of espionage and attempts to make an "orange revolution" in Krasnoyarsk", - says the document.
In addition, the delegates to the Forum noted that "environmental charity organizations are an important element of civil society the construction of which in Russia is so much at heart of its President Vladimir Putin". "We think that prosecution of environmentalists should immediately terminated, and their expertise and knowledge, experience of working with the population should be constructively used", - stated the delegates, many of them representing European "green" parties.
The text of the Statement was sent not only to the leaders of Russia, but also to the parliaments, governments of many countries in Europe and Asia.

Justice and the Case of "Hot" Particles
October 10, 2007. First victory in court. At 16.00 Krasnoyarsk Central District Court reopened its trial to consider the complaint of Krasnoyarsk Regional Public Charity Organization "Citizens` Center on Nuclear Non-Proliferation" to resolution of Krasnoyarsk krai Rospotrebnadzor Directorate № 3225 of July 10, 2007.

The court session lasted more than 1 hour (1 hour 5 minutes). Judge Alevtina Ivanovna Shavrina thoroughly and without bias considered this administrative case, studied all technicalities from the ground up.
October 11, 2007. At 9.00 resolution of the court was announced. Judge Shavrina pronounced for environmentalists, resolution of Krasnoyarsk krai Rospotrebnadzor Directorate on administrative violation № 3225 of July 10 2007 was considered unreasoned and discharged.
October 18, 2007. Another victory in the court. Judge Shavrina again pronounced for environmentalists, resolution of Krasnoyarsk krai Rospotrebnadzor Directorate on administrative violation № 3225 of July 10 2007 was considered unreasoned and discharged.
Local authorities and law-enforcement bodies of Krasnoyarsk krai unexpectedly responded very negatively to the information about "hot particles" found by Vladimir Mikheev and his colleagues and handed over for burial. For the whole year the organization is experiencing diverse pressure from the state (various inspections, and literally prosecution by three (!) Prosecutor`s Offices, Rosregistratskiya Directorate, tax inspection, Rospotrebnadzor Directorate and other authorities). Three (!) times attempts were made to institute against environmentalists criminal case for illegal handling of radioactive wastes under Article 220 of the Criminal Code of the Russian Federation. Absurd accusations of illegal handling of radioactive wastes are still continued.
In October 2007 Krasnoyarsk Central District Court twice discharged resolutions of Rospotrebnadzor Directorate on administrative case. However October 26 and 29, 2007 Krasnoyarsk Environment Protection Prosecutor sent two prosecutor`s appeals to Krasnoyarsk krai Court. Numerous suits are ahead... the green will have to go to court to assert their legal rights. This requires from the organization a lot of time and moneys.
This strange story is far from being completed... Someone "on the top" is very much irritated with the hullabaloo around the radiation problem of Krasnoyarsk krai. The environmentalists can hardly guess what is ahead, but hope that that common sense will be in the ascendant - safety and health of this and future generations of Krasnoyarsk people - is their concern, too. Severe pressure and interference into internal matters of the organization have taken a form of campaign aimed to eliminate the organization and deprive it of the possibility to work actively...
